Licensing Agreement For Music

Published by at 3:20 am under Uncategorized

You cannot sign another agreement with another licensee if you sign an exclusive agreement. This means that you cannot buy the same song from third parties. The advantage is that a music supervisor will probably take you more into account. This is because they know that the song is not used in many other projects. It`s more likely that you`ll get a price for sync fees and get a bigger advance. NOW, therefore, and taking into account the promises and reciprocal agreements contained therein and which want to be legally bound, the parties agree for themselves, their heirs, successors, personal representatives and recipients as follows: 1. GRANT OF LICENSE. One. During the term of this Agreement, as defined below, Licensee has the non-exclusive and irrevocable right to use the copyrighted musical composition on the Site, as well as in television, radio and print advertising and its promotions. The licensee may also use the composition texts in print advertising. B. Notwithstanding the foregoing, Music Publisher hereby acknowledges that it does not grant a license to use the composition in advertising, marketing or promoting any other website for the duration and any possible extension of this website. C.

ASCAP or BMI will grant composition on radio and television channels and networks throughout the United States without special compensation from channels or licensees, such rights to be granted under licensing agreements with broadcasters and networks. D. In the event that the licensee wishes to use the composition on stations or networks that have not entered into a license agreement with ASCAP or IMC, this agreement shall be considered a license for such uses, without restriction or additional compensation. E. Licensee has the right to modify, expand, adapt and make all arrangements, and Licensee has the exclusive right to decide whether, and how, the Work will be published, promoted, published, listed or operated by our successor or assignee. The licensee also has the right to insure a legal copyright anywhere in the world on behalf of the person, company or company he or she can elect, and he or his agents have the right to obtain extensions and renewals of such registrations. 2. TERM. This Agreement shall enter into force on the date of full performance by both Parties and shall be extended for a period of one (1) year from the date. It shall be automatically extended for another (1) year, unless one of the Parties informs the other Party of its intention not to renew this Agreement, such communication being made in writing at least sixty (60) days before the expiry or end of the effective term.

3. INDEMNIFICATION. One. Taking full account of the license granted to it, Licensee shall pay the sum of $[amount] to the Music Publisher, such payment to be made within ten (10) days of the performance of this Agreement. B. In the event that this Agreement is renewed, licensee shall pay the sum of $[amount] to the Music Publisher for each Extended Period, such payment to be made within ten (10) days of the commencement of each Extended Period. 4. INSURANCE AND GUARANTEES OF THE MUSIC PUBLISHING HOUSE. Music Publisher represents and warrants to licensee that: A. He is a member of ASCAP and IMC. B.

The composition is new and original. C. The composition violates and does not violate the copyright or other rights of any natural or legal person. D. There is no negative claim as to composition. E. It owns or controls the composition and all the rights conferred therein worldwide. F.

He has the total and exclusive right and the power to enter into this agreement and to grant it. 5. COMMUNICATIONS. One. All communications required or authorized by either Party under this Agreement to the other Party shall be made in writing: (a) by personal delivery; (b) by electronic fax, with confirmation sent by registered letter or registered letter from the United States first class, requests a return receipt without postage; (c) by a tied courier or by a nationally recognised night delivery undertaking; or (d) by registered letter or first class registered letter in the United States, advance postage, return requested, in any case to the parties at the address indicated above (or to other addresses that the parties may request in writing by notification in accordance with this section). . . .
